Consumers are entitled to a statutory right of withdrawal under the following conditions, whereby a consumer within the meaning of Section 13 of the German Civil Code (BGB) is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor self-employed professional purposes:
The aforementioned right of withdrawal applies exclusively to consumers who, at the time the contract is concluded, have their sole place of residence and sole delivery address within the European Union and the EEA. For consumers who do not meet the aforementioned requirements, a voluntary right of withdrawal is excluded.
A. Cancellation policy
Right of withdrawal
You have the right to withdraw from this contract within 14 days without giving any reason.
The withdrawal period is 14 days from the day on which you, or a third party named by you who is not the carrier, took possession of the goods.
To exercise your right of withdrawal, you must inform us (ArtiTree GmbH, Wevelinghoven 28A, 41334 Nettetal, Germany, Tel.: +49 21538031350, E-Mail: kundenservice@artitree.de) of your decision to withdraw from this contract by means of a clear statement (e.g. a letter sent by post or e-mail). You may use the attached model withdrawal form for this purpose, but it is not mandatory.
You may also exercise your right of withdrawal online at https://artitree.typeform.com/to/N69TrpXK?typeform-source=artitree.com. If you use this online function, we will promptly send you an acknowledgement of receipt on a durable medium (e.g. by e-mail) containing information about the content of the withdrawal declaration as well as the date and time of receipt.
To meet the withdrawal deadline, it is sufficient for you to send the notification of the exercise of the right of withdrawal before the withdrawal period expires.
Consequences of withdrawal
If you withdraw from this contract, we shall reimburse to you all payments received from you, including delivery costs (with the exception of the additional costs arising from your choice of a type of delivery other than the least expensive standard delivery offered by us), without undue delay and at the latest within fourteen days from the day on which notification of your withdrawal from this contract is received by us. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise with you; in no event will you be charged fees for this reimbursement. We may withhold reimbursement until we have received the goods back or until you have provided evidence that you have returned the goods, whichever is the earlier.
You shall send back or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you inform us of the withdrawal from this contract. The deadline is met if you send off the goods before the period of fourteen days has expired.
You bear the direct costs of returning the goods. The costs are estimated at a maximum of approximately 23,99 Euro for shipment via DHL, and at a maximum of 200,00 Euro for shipment via a freight forwarder.
You only have to bear any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary for checking their condition, characteristics, and functioning.
Exclusion of the right of withdrawal
The right of withdrawal does not apply to contracts for the supply of goods that are not prefabricated and for whose production an individual selection or determination by the consumer is decisive, or which are clearly tailored to the personal needs of the consumer.
